What are the things I cannot ask an applicant on an employee application or during an interview?
You cannot ask an applicant about salary history, age (except you can ask if an applicant is over 16, over 18, or over 21 depending on job requirements), dates of school attendance or graduation, marital status, pregnancy/children, sexual orientation/ gender identity, race, ancestry, nationality (including place of birth), citizenship or immigration status, disability or medical condition, religion, military or veteran status, or criminal background. You may ask about criminal background once you have made a contingent offer of employment. However, if you then rescind the offer of employment based on an applicant’s criminal background, you have to provide that applicant with a written assessment of your decision.
